Right of Withdrawal
You have the right to withdraw from this agreement within 14 days without giving any reason.
The withdrawal period is 14 days from the date:
• on which you, or a third party designated by you, who is not the carrier, takes possession of the goods, provided you have ordered one or more goods under a single order and these are delivered uniformly or have been delivered;
• on which you, or a third party designated by you, who is not the carrier, takes possession of the last goods, provided you have ordered one or more goods under a single order and these are delivered uniformly or have been delivered.
To exercise your right of withdrawal, you must notify us of your decision to withdraw from this agreement, which can be done via email: support@modélia.com. You may use the attached model withdrawal form, but it is not mandatory.
To comply with the withdrawal period, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this agreement, we will refund all payments we have received from you, including delivery costs (except for the additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), immediately and no later than 14 days from the day we receive the notification of your withdrawal. We will use the same payment method for the refund that you used for the original transaction, unless you expressly agree otherwise; in no case will this refund incur any costs for you.
We may withhold the refund until we have received the returned goods or until you have provided proof that you have sent the goods back, whichever occurs first.
You must return the goods without delay and in any event not later than 14 days after the day on which you informed us of the withdrawal from this contract. The deadline is met if you return the goods before the 14-day period expires.
You will bear the direct costs of returning the goods.
You will only be responsible for the diminished value of the goods if this loss in value is due to unnecessary handling by you and this is checked in relation to the nature, characteristics, and functioning of the goods.
Reasons for Exclusion and Expiry
The right of withdrawal does not exist for contracts:
• for the supply of goods that are not prefabricated and which are made on the basis of an individual choice or decision by the consumer that is decisive or which is clearly tailored to the personal needs of the consumer;
• for the supply of goods that may deteriorate or expire rapidly;
• for the supply of alcoholic beverages, the price of which was agreed upon at the time of the contract, and which cannot be delivered until at least 30 days after the contract was concluded, and the current value of which depends on market fluctuations that the entrepreneur cannot control;
• for the supply of newspapers, periodicals, or magazines, with the exception of subscriptions.
The right of withdrawal expires early for contracts:
• for the supply of sealed goods that are not suitable for return due to health protection or hygiene reasons if their seal has been removed after delivery;
• for the supply of goods which, after delivery, are inseparably mixed with other goods due to their nature;
• for the supply of audio or video recordings and computer software in a sealed package if the seal was removed after delivery.
